According to the Dutch Working Hours Act, violations of Regulation 561/06 and 3821/85 can be fined alongside the road. The fines are imposed by the IVW (Vehicle Inspectorate) and the Dutch police. It is possible that vehicles may be impounded until payment has be done. Fines are in the range of € 110 - € 4.000 per violation for drivers and employers. In general fines for not complying with record sheets etc. will be charged against driver, while breaking the hours of rest periods and driving time will be. brought up against the company. Since the introduction of the digital tachograph, accumulation of fines for 28 days can be very costly. A complete list is available.
Objection against the order to pay the administrative fine is possible within a period of 6 weeks. When objecting by writing to the administrative body a copy of the receipt of the administrative fine should be included. The grounds of objection require skill of the Dutch national legislation on the Working Hours Act and the Decree on Working hours of the Transport Sector.
