Use Spanish or German attestation

We advise our clients to use the Spanish or the German ‘attestation of activities' to be used when a driver has been on sick leave or was on leave. This form declares why the driver can not present tachosheets because he did not drive on one or more days. The prescribed forms have be drawn up by the Commission in all languages.[1] Member States are not obliged to use them, but when drivers use them it should be the prescribed form. It is not allowed to modify the form and it can only be filled in by typing. It must be signed both by the company representative and by the driver in order to be valid. The letter is to be showed mainly in Belgium, France and Spain.
The English, French and Dutch attestation give as one of the options ‘annual leave' while Spanish an German forms speak plainly about ‘leave'. Drivers might be tempted to cross the word ‘annual' which is an infringement. However one day leave is probably not ‘annual leave' which could be considered a false attestation. As it does not matter in which language a driver produces the form, we have advised the use of the German or Spanish form.
